  • North Carolina 2005:  Obtained Supreme Court and Court of Appeals orders affirming dismissal of Plaintiffs’ Deceptive Trade Practice Act (DTPA) claims on standing grounds.  
  • South Dakota 2005:  Plaintiffs voluntarily dismissed their statewide DTPA claims with prejudice after full briefing on defendant's motion for summary judgment.
  • Maine 2005:  Plaintiffs’ motion for statewide class certification denied on basis of briefing alone.
  • Michigan 2005:  Successfully petitioned Michigan Supreme Court for interlocutory review of trial court's denial of summary judgment for class-action defendant. After briefing and argument, the Court of Appeals ordered the case dismissed on limitations grounds.
